The terms in Sections 2 through 10 of this Agreement ("EULA Terms") supplement the MIT License. These EULA Terms govern your use of the Software as an end-user application. In the event of any conflict between the MIT License terms in Section 11 and the EULA Terms in Sections 2-10, the more restrictive terms shall apply only for the specific conflict, with the intent of the MIT License being honored for the rights to the software code itself, while the EULA Terms govern data, privacy, warranties, and liability related to running the application.
For clarity:
SysInfoCollect ("the Software") is a system information collection utility. Its primary function is to gather and report technical specifications and data about the hardware, operating system, and runtime environment of the device on which it is installed. The specific data collected, the format of the report, and its storage or transmission are defined by the Software's functionality at the time of use.
The Software is designed to collect system information. This may include, but is not limited to: hardware identifiers (e.g., CPU model, RAM size, disk drives), operating system details, installed software, system configuration, and performance metrics.
You retain all rights to any personal data on your device. However, by using the Software, you grant the Author the right to collect, process, and use the anonymized, aggregated system information data generated by the Software.
The collected system information data may be used by the Author for purposes such as:
The Author intends for the Software NOT to deliberately collect sensitive personal information (such as keystrokes, browsing history, personal documents, passwords, or user account details). However, system information may sometimes include data that could be considered identifiable (e.g., computer name, usernames). You acknowledge this inherent possibility.
The Author does not guarantee the security of any data collected. You are responsible for understanding how the Software handles data, including if and where it is stored or transmitted. Use of the Software is at your own risk regarding data privacy.
NOTWITHSTANDING THE DISCLAIMER IN THE MIT LICENSE (SECTION 11), AND TO THE FULLEST EXTENT PERMITTED BY LAW: THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. THE AUTHOR EXPRESSLY DISCLAIMS ALL WARRANTIES BEYOND THOSE STATED IN THE MIT LICENSE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES REGARDING FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SOFTWARE WILL OPERATE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.
IN ADDITION TO THE LIMITATION IN THE MIT LICENSE (SECTION 11), AND TO THE FULLEST EXTENT PERMITTED BY LAW: IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, DATA, OR DATA USE, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE AUTHOR'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS UNDER THIS AGREEMENT SHALL BE LIMITED AS SET FORTH IN THE MIT LICENSE (I.E., TO ZERO).
The MIT License is perpetual. However, your right to use the application under this EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term(s) of Sections 2-10 of this Agreement. Upon such termination, you must cease all use of the Software.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction of the Author's residence, without regard to its conflict of law principles.
This Agreement (including the incorporated MIT License in Section 11) constitutes the entire agreement between you and the Author concerning the Software.
The Author reserves the right, at his sole discretion, to modify or replace the EULA Terms (Sections 2-10) at any time. The MIT License (Section 11) attached to a specific version of the Software is perpetual for that version. It is your responsibility to review this Agreement periodically for changes. Continued use of the Software following the posting of any changes to the EULA Terms constitutes acceptance of those changes.
